City Council

SECTION 3.01          General Powers and Duties

All powers of the City shall be vested in the City Council, except as otherwise provided by law or this Charter, and the City Council shall provide for the exercise thereof and for the performance of all duties and obligations imposed on the City by law.

SECTION 3.02          Composition; Eligibility; Election and Terms

(A)Composition.  There shall be a City Council composed of the Mayor and five (5) Councilmembers; the Councilmembers shall be elected by the voters of the City at large, by place, and the Mayor shall be elected as provided in subsection (C) of this Section and in Section 3.03.

(B)Eligibility.  Only registered voters of the City shall be eligible to hold the office of Councilmember or Mayor.

(C)Election and Terms.  Councilmembers shall be elected to serve staggered four (4) year terms in municipal elections held every other even year.  At the first election under this Charter, candidates receiving a majority of votes for Place 1, Place 3, and Place 5 City Council seats shall be elected to serve four (4) year terms.  At the second municipal election held under this Charter, candidates receiving a majority of votes for Mayor, Place 2, and Place 4 shall be elected.
